These Terms of Service (“Terms”) govern your access to and use of MonkeyTalker (the “Service”), operated by MonkeyTalker (“we”, “us”). By creating an account or using the Service you agree to these Terms.
1. The Service
MonkeyTalker lets you build cartoon characters and generate short videos from a written script or an audio file, including automatic lip-sync, captions, stock media and an editor. Rendering happens in the cloud. We may change, add or remove features at any time.
2. Accounts
You must be at least 16 years old (or the age of digital consent in your country) to create an account. You are responsible for keeping your login credentials confidential and for all activity under your account. Tell us at [email protected] if you suspect unauthorized use.
3. Plans, billing and cancellation
- Free plan. Includes a limited number of video minutes per month, one character and a watermark on exports. No payment method is required.
- Paid plans. Starter, Creator and Business are recurring subscriptions billed monthly or annually in USD through our payment processor. Prices are shown on the pricing page and may change with notice; changes apply from the next billing period.
- Founding Member. A one-time payment that grants the Creator plan features for the lifetime of the Service, subject to these Terms and to fair use of render minutes.
- Minutes. Each plan includes an approximate number of rendered video minutes per month. Unused minutes roll over for up to three months. Top-up minutes purchased separately do not expire.
- Cancellation. You can cancel from your account at any time. The plan remains active until the end of the period you have already paid for. We do not issue partial refunds for unused time unless required by law.
4. Your content and your rights
You keep ownership of the scripts, audio and other material you upload (“Input”) and of the videos you generate (“Output”). You grant us a limited license to process Input and Output only to provide the Service (for example, to render and store your videos).
- On the Starter, Creator, Business and Founding Member plans you may use Output for commercial purposes.
- On the Free plan Output is licensed for personal use only, and exports carry a “Made with MonkeyTalker” watermark that may not be removed.
- Characters, voices and stock media provided by the Service remain licensed to you only as part of Output generated in the Service.
5. Acceptable use
You agree not to use the Service to create content that is unlawful, defamatory, harassing, sexually explicit involving minors, infringing on someone else’s rights, or that impersonates a real person in a misleading way (including cloning a voice without consent). We may remove content and suspend accounts that violate this section.
6. Availability and support
We aim for high availability but the Service is provided “as is” and “as available”. Support is offered by email at [email protected]; response times vary by plan.
7. Limitation of liability
To the maximum extent permitted by law, MonkeyTalker is not liable for indirect, incidental or consequential damages, or for loss of data, revenue or profits arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim.
8. Termination
You may delete your account at any time. We may suspend or terminate accounts that breach these Terms. Sections 4, 7 and 9 survive termination.
9. Changes and governing law
We may update these Terms; material changes will be announced in the app or by email before they take effect. These Terms are governed by the laws of the jurisdiction in which MonkeyTalker is established, without regard to conflict-of-law rules.
